Abstract

The criminal justice system is intended to follow the wants and needs of society. The issue that may arise when invoking the death penalty is “What constitutes justice?” Is society by using the death penalty fulfilling the needs of society, so that citizens know what types of punishment will be carried out? Is it trying to fulfill the needs of the victim’s family? To carry out justice, considerations should include the severity of the crime and the blameworthiness of the offender. Yet it is important that society makes certain, when handing out punishments such as the death penalty, that it is more than viewing the crime as a tort, where the victim’s needs and retribution are the sole considerations.
